Guide for Environmental Enforcement Authorities on the Determination and Implementation of Fines

13 May 2022

As part of the activities for “Strengthening Administrative Capacities for the Enforcement of Environmental Legislation”, a practical Guide for environmental officials was prepared, presenting in a systematic manner all actions to be undertaken by inspectors when determining and implementing fines.

The Guide is intended for officials of the Ministry of Environment and Spatial Planning, officials of the Environmental Protection Inspectorate, municipal environmental inspectors, as well as all officials who have responsibilities for enforcing environmental legislation in the Republic of Kosovo.

The Guide provides sufficient information on the legal basis under which fines are imposed, as well as the procedural actions that must be followed when imposing such penalties. It also provides templates that can be used when determining and preparing penalties, such as official reports, decisions, requests, proposals, etc.

This document provides an overview of all applicable legal provisions in the fields of environment, water, construction and housing that correspond to the inspection powers of inspectors. It also contains legal provisions on inspection supervision so that inspectors are aware of the legal basis for their powers as inspectors.

The Guide provides a brief description of central and local-level institutions with responsibilities for enforcing environmental legislation. These primarily include the Ministry of Environment and Spatial Planning, the Environmental Protection Inspectorate, the Kosovo Environmental Protection Agency, and other law enforcement institutions.
