09 September 2011

09/09/2011 - The Ministry of Environment and Spatial Planning (MESP) on Thursday requested the initiation of a misdemeanor procedure against NEWCO Ferronikeli COMPLEX LLC.

Following an inspection carried out by the MESP Inspectorate, the Ministry of Environment and Spatial Planning noted that Feronikeli, with its smelting and Fe-Ni production activities, as a source of environmental pollution, is not complying with legal obligations based on the current legal provisions for air discharge monitoring.

The operator in question has not fulfilled the legal obligations sanctioned with punitive provisions for misdemeanors according to Article 38, paragraph 1.4 of the Law on Air Protection from Pollution no. 03/L-160, the MESP statement reads.

Meanwhile, in the reasoning of the Environmental Inspectorate, it is stated that during the inspection supervision at New Co Feronikeli LLC in Gllogovc, it was found that the company in question still does not have an installed system for internal monitoring aimed at tracking the level of air pollution from gas and dust emissions from the technological production process, which is in violation of the legal obligations of the Law on Air Pollution Protection and the Administrative Instruction on the rules and standards of air discharges from immovable pollution sources.

Due to the failure to install an internal monitoring system for the continuous monitoring of air pollution and other environmental factors and due to gas and dust emissions, a severe and uncontrolled environmental situation has been created, which affects public health and the pollution of the surrounding environment of the complex and beyond. This makes the economic operator New Co Feronikeli LLC in Gllogovc responsible for the severe environmental situation, it is stated, among other things, in the reasoning of the Environmental Inspectorate.
